Notice Warning Concerning Copyright Restrictions:

The copyright law of the United States (title 17, United States Code) governs the making of photocopies or other reproductions of copyrighted material.

Under certain conditions specified in the law, libraries and archives are authorized to furnish a photocopy or other reproduction. One of these specific conditions is that the photocopy or reproduction is not to be “used for any purpose other than private study, scholarship, or research.” If a user makes a request for, or later uses, a photocopy or reproduction for purposes in excess of “fair use,” that user may be liable for copyright infringement.

This institution reserves the right to refuse to accept a copying order if, in its judgment, fulfillment of the order would involve violation of copyright law.

Requests to copy material constitute an agreement that you will not reproduce, transfer, distribute, broadcast, publicly display, offer for sale, or otherwise use or publish any material subject to copyright, or a portion thereof, in excess of “fair use” as defined by copyright law, without the express permission of the copyright holder. You are solely responsible for determining the copyright status of materials, if not otherwise stated, and obtaining permission to use material from the copyright holder. OHS will not facilitate or execute additional requests for permission.

Delivery or download of digital reproductions shall not transfer any underlying rights to the images to you or to any third party. Underlying rights to the OHS copyright-held images are not sold; the images are provided for limited purposes as described in the rights statement attached to each digital object. All images remain the physical property of OHS and the intellectual property of the copyright holder, if applicable.

We reserve the right to restrict the use of certain items and to deny a reproduction request due to copyright regulations, privacy rights, donor-imposed regulations, or other rights related issues.

Note on Privacy, Publicity, and Other Rights:

The rights OHS grants to you do not include a license to any persons, places, property, or subject matter depicted in an image, which may be subject to copyrights, trademarks, rights of publicity, moral rights, property rights or other rights belonging to third parties. OHS makes no representations or warranties that it owns or licenses any such rights, nor does OHS grant you any rights including copyright, trademarks, or rights of publicity belonging to any person, place, property, or subject matter depicted in any image. Further OHS makes no representation or warranty as to the accuracy of any information provided with the images. You are solely responsible for determining whether your use of any image requires the consent of any third party or the license of any additional rights, and you should not rely solely on the information provided by OHS. If you are unsure whether additional rights are needed for your use, you are responsible for consulting with legal counsel.

Notice and Takedown Policy

In order to make its collections available to the widest audience possible, the Library has placed reproductions of items from our collections online. In each instance, we have tried to make sure that we have secured all necessary rights. If you believe that we have made a mistake, please contact us so that we can correct the oversight.

It is our policy to respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act in an appropriate manner under such Act and other applicable intellectual property laws, including the removal or disabling of access to material claimed to be subject of infringing activity. Pursuant to title 17 United States Code 512(c)(2) (Digital Millennium Copyright Act of 1998), The Oregon Historical Society has designated an agent for notice of alleged copyright infringement appearing on the OHS Digital Collections site.

To file a notice of infringement, you must fulfill the requirements specified in Title II of the Digital Millennium Copyright Act of 1998. All infringement claims must be in writing and must include the following information:

  • A physical or electronic signature of the copyright owner or the person authorized to act on its behalf;
  • description of the copyrighted work claimed to have been infringed;
  • description of the infringing material and information reasonably sufficient to permit OHS to locate the material;
  • Your contact information, including your address, telephone number, and email;
  • statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  • A statement that the information in the notification is accurate, and, under the pains and penalties of perjury, that you are authorized to act on behalf of the copyright owner.
